This is where our previous 'take a pinch' and keep our powder dry approach is paying off imo. We've let them rubbish us in the media for years to the point where it's drove many to distraction. UEFA and the cartel have got into the habit of thinking they can say, leak and do whatever they want in the media and we won't retaliate...until now. It looks like they've dropped themselves right in it by leaking info to the press in what was supposed to be an independent investigation and it's difficult for them to go back - wasn't today supposed to be the day our ban was announced? Well shit or get off the pot.

Not only that but it looks like City are hugely confident that the only 'evidence' UEFA has is the leaked emails from that discredited German rag. Maybe there is evidence of wrongdoing in the emails, but I can't see them going into a court with the only evidence being illegally obtained and I doubt our management can either. But again, due to our previous softly softly approach they've thought we would roll over and have our tummy tickled again.

I like to think of City as Michael Corleone in the Godfather... understimated by his peers... but looks like we've just go to the final scene of the movie - during the Christening, if you get my drift.

Yep i know, but how do you prove he is where the information came from? From memory, i believe there are some laws that protect the whistleblowers identity from being leaked, so they might be able to just make it all up so they can get the evidence into court..

Seriously lad, he is not a whistleblower.

The person has been caught and is presently in court for HACKING, for illegally hacking into our and others email accounts.

Again, not whistleblowing.

The EUFA stance appears to be that the CL is their competition so clubs who enter do so under their rules, including FFP which they found City have breached.
City appear to not just be questioning FFP but EUFA itself and related parties perceived to be setting out to smear the Clubs' reputation and damage their commercial interests.

The stakes are very high on both sides and could be taken to a higher court. It will be interesting to see if other parties become involved. For example FIFA already has an agenda with EUFA. There is also the possibility of legal questions over cartels and anticompetitive practices coming to the fore that would over-ride EUFA competitions and FFP.

In court, could it be possible that he may have 'hacked' our emails on the bequest of third-parties... and if so, will he be made to reveal those third-parties?

And he used his skills to successfully blackmail a Caymans Isle bank(?) and to attempt to blackmail football clubs and possibly agents. He's no white knight on horseback for sure.

We don't know who leaked it. I suspect it isn't the IC committee members, but is more likely to be a random staff member who knows something of what is happening.

Doesn’t matter. It was leaked and gave City the opportunity to counter on the process and the integrity and motivation of the investigators.

Have City been creative in circumventing FFP to some extent? Probably. That’s their job. Can UEFA prove it? Unlikely. A suggested one year ban isn’t screaming they have City bang to rights. Besides who thinks UEFA really want a war over a poxy one year CL ban especially as they are in the middle of planning a CL stitch up to appease the ‘entitled’ few? Nothing says we are protecting the integrity of football like shafting 99% of European clubs.

The only way i can see UEFA taking this seriously is if they can take Der Spiegels 'evidence' as a whistleblowing leak rather than hacked accounts. I assume if its a whistleblowing leak then it could probably be used as evidence in an actual court of law?
The guy is currently in custody awaiting trial for what he did. If found guilty then surely Uefa would be daft to think it could be used in a court of law

That's still not whistleblowing. Whistleblowing is Vicky Kloss handing Tolmie our transfer list in a brown envelope in a car park ;-)

But yes, you have an interesting theory on this. If that person was employed to do this, shit is going to get real.

I know mate, i've read everything about him but the point i'm making is, HOW do we prove that the leak has come from him? Der Spiegel could simply say 'nah we didn't get it from that guy, it was a whistleblower and we don't need to tell you who that was'. Just playing devils advocate, kind of.

Crockett and Tubbs would do a better job investigating us than these fuckwits

Talksport bulletin “Pep Guardiola’s side have been referred to Uefas disciplinary body”. Really, wtf has Pep’s team got to do with a five year old issue?

They probably will, but I think the club will unleash a legal team that make OJ's defence team look like a bunch of nursery school kids tbh
Essentially the only option we have. But we need to have all our ducks in a row very quickly. I reckon they will bring down the hammer sometime in the next 6 weeks. I hope we don’t let this drag out too long

Does anyone know how stolen emails would stand up in court?

Or would a judge simply dismiss any evidence than was obtained by theft?
Some countries will dismiss it out of hand (such as USA and Russia) but others may allow it including the UK and Switzerland (where CAS are). In countries where it is at the judge's discretion, there are differing rules on what can be allowed. I think we, and possibly Switzerland, allow quite a lot in comparison to, say, France.

Based on a little research I did the other day.
