Yup. I've actually signed a contract with a clause in that my lawyer thought would be unenforceable (on me and) I simply chose not to spend time and money negotiating the point.
Me too, when I was made redundant last year. My package said that I couldn't work for a competitor for 3 years or something. We just told them to fuck off and I did just that.

I don’t get all the upset. City aren’t challenging this in a court nor have we ever suggested a court challenge.

We have gone to CAS to have it thrown out on grounds of due process and can do so again (if a punishment is recommended).

Nothing has changed at all.

However when I left after 7 years I challenged that in court and won.
Any clause whether agreed to or not has to be lawful.
 
Fantastic post as ever. There was a telling line in the club's statement following the DS 'revelations' that described the attempts to damage our reputation as "clear and organised"
This current trial by media and kangaroo court is a mere sideshow in the long-term aim of reputational damage.

I cannot transpose my defiant I'm a City supporter stance with its bring it on I've heard it all before attitude to our current expectation of a 5 _ 0 victory every game.

Very interesting that it is also rumoured that FFP may be changing how it is ran. This being due to UEFA having to fight lengthy legal battles in the courts.

However, this article seems to be directly talking to someone about our case, with it finishing on a statement from a person close to UEFA’s investigations !!!!! (Very last paragraph)

So thats another breach then on UEFA’s part
 
Wasn’t the difficulty with the Dupont farce that he couldn’t argue that he was representing an affected party, so the Belgian and European Courts have spent 4 years kicking the case back to one another, without anyone being prepared to accept responsibility for it. A case that takes years to be heard would not suit City if we were banned in the interim.
Placing our faith in CAS seems our only option, and honestly I wouldn’t know what to expect there. What I do believe is that after all the very deliberate media hysteria, I’m not convinced we could get a fair trial anywhere outside of a State Court. Still, there are probably political forces at play that may assist us
Yes, but if they ban us there will be plenty of affected to represent, players, agencies, sponsors,... But I think that this issue will be solved by CAS.

Also, not one knows if a legal challenge to FFP would or would not work and they din't even discuss the Swiss Court.

Oh and the idea that FFP is not anti-competitive when it comes to preventing a club invest so that it can compete is still bullshit IMO. On-going overspending and investing to build something up are two different things. If FFP does not make proper allowance for investment, it's anti-competitive in my view.

City invested and moved to profitability and are not the club currently inflating the transfer or wages market.

I know all of those things and I agree completely. My anger and frustration is not with City, but this whole bent charade, and I have zero faith in us ever getting a fair or competent hearing. Who will want to be the individual who lets the “cheats” “get away with it”?

Ironically, one of the main protagonists against us is Sky. You know, the Company that spent (invested) multi millions, had debts every year, but are now profitable...

That’s the point surely.

City use SAP I assume & SAP will have a user-group. If the committee of that user-group signed a MOU with SAP that their members couldn’t pursue legal avenues in the event of losses due to software issues then that may well be binding but it doesn’t necessarily make it legally enforceable.
 
Yes, Stefan has a legal background and is our resident font of legal knowledge on Twitter. I’ve asked him the latter question (does the MOU prevent us from contesting FFP disputes and punishments only, or does it extend to challenging FFP on anti-competitive grounds as well), but I haven’t had a reply yet

Our chairman certainly seemed to be of the belief there is legal recourse if expulsion from the competition ever came?
 
See that’s interesting, the fact the entire establishment hates us makes me support city even more, and my dad raised me with the that in mind considering the we are the only part of the family that don’t support the rags. The success just makes them hate us more and in turn makes me love us more

Amen to that brother. I’ve never felt such boiling resentment toward so many people - UEFA, the G14, dippers, rags, pundits, the media - nor so much desire to defend the club I’ve loved all my life. Reining in my temper with these people is becoming harder and harder though. What we’re having to put up with, from the media in particular, is unprecedented, and that City employee getting a corrosive substance thrown in her face was a perfect encapsulation of the consequences of what these irresponsible, spiteful, click driven wankers are orchestrating
