It's deemed fair by the European Commission, but they're just the EU version of our Civil Service. The EU Commission backed UEFA over Bosman, but when the case was appealed all the way to the European Court of Justice, the ECJ found in favour of Bosman.

Essentially, the ECJ told the European Commission, EU Law had nothing to do with them, & to stay out of it. Whether the UK is in Europe or not, we're about to find out that dealing with Europe has to be on their terms, otherwise we can feel free to create a UK Champions League of our own, with Bangor City, & Queen of the South et al.

TfEU was in no way a European imposition but is rather a statement of commercial law as it existed in western European capitalist, free market economies at the time. Ever since 1945 at least every free economy in Europe has seen investment and competition as the only way to reconstruction and prosperity. British airlines were fined massively for acting as a cartel to force Freddy Laker out of business in the 1960s and attempts to prevent investment have always been illegal. TfEU simply stated clearly and unambiguously that these anti competitive practices were, as they had been for many years, unlawful throughout the EU, including those new members from the old Soviet bloc. The ECJ will be no more sympathetic to UEFA and the cartel than our courts, or vice versa after this year.

It boils down to the simple fact that we can buy top drawer players, which we couldn't previously do.
