Provide that City follow legal process, then there is no possible claim for losses, CAS rules allow for provisional and conservatory measures, if this meant we competed in ECL 20/21 because CAS haven't completed their process then that is not City's liability

When deciding whether to award preliminary relief, the President of the Division or the Panel, as the case may be, shall consider whether the relief is necessary to protect the applicant from irreparable harm, the likelihood of success on the merits of the claim, and whether the interests of the Applicant outweigh those of the Respondent(s).

Thanks for that. It certainly makes it clear that there is perhaps even more pressure on Uefa for CAS to hear our appeal sooner rather than later.

If anything, we should hope it drags out for that very reason!

Although annoying UEFA has its definite upsides I just want this done and dusted. Besides, this is an ideal moment to bury bad news.



(bad news for our competitors of course :) )
 
Not sure how authoritative those two "experts" (John Shea and Christopher Flanagan) are, but they didn't sound particularly confident of our chances in winning the appeal, to me at least.

What I took from reading that is that these 2 so-called experts (and they may well be) were doing their level best to debunk most of the arguments City may or may not put forward at appeal but when it came to the single most important factor - the club claiming to have irrefutable evidence that we haven't done anything wrong anyway (this assumes the club is telling the truth on that of course) - neither could give an opinion on that as they don't have a clue what that evidence is! In other words, a pointless article full of speculation.

I was led to believe that CAS mainly look at procedures and these procedures have been followed in the correct way. If this is the case surely City have a very sound argument.

Not if it results in the destruction of UEFA as the G14 would quickly fill the void with something of their creation.

We all know what that would mean! Permanent places at the top for irrelevant clubs such as Milan and United alongside their mates: Bayern, Juventus, Real Madrid et al.

The objective must be to beat UEFA without destroying them.
 
I believe it's been stated as infinitum that CAS can consider far more than due process. Hence continued reference to the allowance, on previous occasions, of evidence into an arbitrary hearing that no "proper court" would allow because of its provenance.

Exactly my take. Pretty poor article IMO. It doesnt add anything new and attempts to refute Citys supposes arguments without really knowing them. Plus as PB mentions above brings out the over stating income argument.

The problem of trying to win the case is going to be the most difficult part of our case JGL07 without destroying UEFA. There are only two ways for that to happen and that is for us to lose this case. If we win this case UEFA would have to seriously look at all of it's laws and rewrite them all. The only other way is for UEFA to back down and say sorry and pay all of our expenses to date. Which also will not happen.

Or, we win on process which allows for it to be pinned on the IC and AC, which are then reformed/abolished.

We then start our work on targeted individuals/clubs.
 
As CAS has released a notification that our case will not be heard until after June. Looks like we will be in for along wait. I do remember quite a few years ago, of one team being suspended from all European Comps. This club put an appeal in, and were allowed to continue in European Comps until the hearing was heard and the result released. However I cannot remember the club involved. It mat have been an Italian club.
 
I can't believe how squeamish some are, wishing to win the case without destroying UEFA. Give your heads a wobble and when they clear just ask yourselves what it is about UEFA that is so valuable we have to put on the kid gloves before we defend ourselves! Is it the UEFA that comes up with a series of unlawful regulations to screw us? Is it the UEFA that changes these rules because they've had to tell us that we'll pass the test and that can't be allowed to happen? Is it the UEFA that chooses to trust the claims of a criminal to justify reopening a non-existent case against City? Is it the UEFA that wants a two year ban and massive fine second time round? Or is it the UEFA that wants the CL to be reserved for the cartel clubs? Wake up and realise that "UEFA" and "cartel" are synonyms. If City win this case, as I fully expect them to, those officials responsible for FFP and the campaign against City, will either have to go (possibly to jail) or remain in office as emasculated jellyfish. UEFA will learn that it has to abide by the law or be swept away.

Please can you be a bit more specific? I genuinely cannot think of one good attribute, or upside of this bent, corrupt, self gratifying organisation, They are crooks - nothing else!

If UEFA is destroyed by this then it's actually very little to do with city and everything to do with chickens coming home to roost on a corrupt organisation that's been caught with its pants down. In disputing the ban through CAS and perhaps the courts we are simply following process. If UEFA had followed due process then they would not have backed themselves or us into the corner in which we all find ourselves.

No they don't. To destroy the people you have also to destroy the structure. The only way to get rid of the old gang is to smash FFP and the whole machinery created to maintain it. There can be no compromise - no-one can simply argue that they want a more palatable cartel to replace this one. What we must have is a governing body which governs within the law, not one which is forever seeking to pervert the law for the benefit of their friends and themselves.
