Agreed. The only cause of action against Spiegel would be if they tampered with the email to give a false impression. We have never accused them of that.

If they do then let's start the ball rolling. We can still do Der Speigel for theft, even though they printed the story in Germany the theft was on our data base and therefore happend in this country. That’s the 10 million dollar question. As things stand No because we have been banned but have appealed to the CAS. However, it doesn’t look like we have formally asked for the punishment to be staid pending our appeal. I think there’s some brinkmanship going on - whereby we haven’t asked for the case to be staid because we know that creates a huge issue for UEFA - If we serve a ban and then get exonerated, it would result in a huge claim for damages that would bankrupt UEFA. Of course if UEFA are not sure of their ground and think a huge compensation claim might be heading their way they might blink first and show their weak hand. All good fun and I’m sure our lawyers are piling the pressure on UEFA right now. This pandemic will have tipped the financial scales even further in our favour - I would guess.

Only if we ask for a suspension I believe, CAS won't automatically give it us.

Yes, unless the season is curtailed and the rags end up in 6th due to whatever criteria they use. In that case it will go to the 6th place team as that is fairer.

Probably not necessarily.
If the season was completed, then it would be difficult to not do so.
If the season is not completed, UEFA have something written which talks vaguely about 'sporting merit'.

apart of me thought the FA wanting to finish this season was not only wanting the dippers to “officially” win it, but then get the rags into the CL.

Uefa said National Associations can select clubs if their leagues cannot be finished for "legitimate reasons".

If a season is not finished for reasons that do not meet Uefa guidelines then the body can reject the teams put forward by a national association.

It said it could refuse selections if they were not deemed to have been chosen in a way which was "objective, transparent and non-discriminatory" and can also refuse entry to selected teams if "there is a public perception of unfairness in the qualification of the club".

There it is.... the punchline, the whole point of their contrived ‘investigations’.
The constant drip feed of leaks which could wreck their case, has been at the very centre of it.
It doesn’t matter if we have breached the so-called ffp regs, uefa were never really interested in the substance of the case, all they wanted to do was get as much poison and lies into the public domain with the view that enough shit would stick and ‘public perception’ could be massaged into the pile of lies and smears that we see now.
They’ve seen the by-passing of the truth done successfully by lying and obfuscating politicians on both sides of the ocean, and they have made it their target to do it to us.
Their problem now is, who decides what the public perception is?
Obviously they do.
