I think that is pretty much their claim. But its nonsensical in law and accounting so surely has to fail.
This is my query. UEFA say we mislead the auditors and this was not in the spirit of the rules (however bent they may be). We are being charged regarding breach of these rules. I don’t think the law comes into it? I assume CAS are ruling on our actions in respect of these rules not the rules themselves. That would need a court of law.
 
Actually, on the very last point I disagree, and this may well be the crux of everything. IMO CAS have to rule on the rules, not on the emotions that the emails can evoke in people. The question is are UEFA within their own rules in a) using the leaks to re-try a previously settled case AND b) if they are, do the leaks prove clearly that the UEFA's rules were broken.

Khaldoon and Simon Pearce are not little guys. Soriano and Begiristain are little guys. And the confidence and bullishness isn't coming from the little guys. Khaldoon and Pearce simply wouldn't take that stance without strong advice that they were on solid ground. The ramifications of being wrong are pretty severe on every level. It's not like they're privately saying to the players "this could go either way" - every single one of them has been told that the club will be 100% vindicated. That's a balls out strategy if you're playing with a weak hand.

As much as I try to kid myself that I’m weary of football and all the bullshit we continually face, if we manage to overturn that ban (on whatever grounds), it’s gonna feel as significant as any trophy win

I don't think Khadoon or the club cares how and why we win.

We get the hell out of Dodge.

We can never be exonerated in the eyes of those people who refuse to see.

I don't quite get how a reduction of the ban can be an option. We're either guilty or not right? If we're guilty and CAS agree we'll get the two year ban, and if not, we get cleared. Unless i'm missing something here? I don't think City stand to gain anything by accepting a one year ban. It's all or nothing.

If we leave without a ban it will have a HUGE impact on player recruitment and even current players signing new contracts.

It’s probably too late for Leroy but I wouldn’t be surprised if he was told on the sly from Bayern a while back that we’d be banned and that they’d come in to rescue him.

Take that potential ban away and it will be a huge moral boost for the current players and players we don’t currently have like Sancho might suddenly feel the need to reach out, especially if rivals like United are in the Europa.

Great to see @projectriver on here giving an experienced lawyer’s view on the process and proceedings.

Still find myself a little confused by the whole process so far if only because in effect the main allegation is that we have misstated the source of our sponsorship monies. This in turn would mean that our audited accounts wrongly state this and there are far more serious issues that arise from this.

Unfortunately the whole process isn’t very transparent so we don’t even know with any certainty what City were accused of and subsequently found guilty of.

In any event the final CAS decision will have enormous ramifications for City and united. If we win they face another season out of the champions league and loss of income and bonuses that arise from that. Considering the state of their finances at present that would be a huge problem for them.

So a City win at CAS could have a double whammy, it removes the clouds over our future while putting a major squeeze on united.

For this situation law means relevant rules and laws (and CAS does consider laws btw).

City likely to ask for a specific consideration of proportionality if their other arguments fail so there is a way in which 2 years can become 1. I think unlikely though
 
That's my point, guilty or not, City are guilty in the court of public opinion.

I don't care what Dippers and rags think, I care if we come out of it with legitimate guilt attached because whilst the media and certain clubs hate us I know plenty of fans of other clubs who think it's a nonsense, but that changes if some actual guilt emerges.

Then I think plenty will end up disappointed?

We may win or lose on technicalities, everything after that is whatever confirmation bias others will place upon the verdict.

I couldn't care less if we have sailed close to the wind, these rules have tried to thwart us at every turn.

I'd be disappointed if we were sloppy enough to have been caught with our hands in the cookie jar, but I won't lose any sleep if fans that were previously in our corner suddenly think worse of us.
