CAS judgement: UEFA ban overturned, City exonerated (report out p603)

I have just tried to read the award and cannot get my head round it. In fact it may as well have been written in Manderin. Will PB. translate the document so the average Joe Egg can get to grips with it. Shortly the wife will ask me what it means and all I will have to offer is a blank look. Thanks.

I know the wife and the sister are the same person in Yorkshire but they don't count as 2 people on the attendance!

I'll translate.

In English: You've read the wrong document. The one you're looking at relates to our initial appeal, I assume, which was rejected by CAS.

I think you must have got a leaked, still encrypted version as it's not been released yet.

There was nothing about 'technicalities' in the award release, time-barred of course was there. I suspect with the crap CAS have received for the last one, they've taken the extra time to make sure that there's no room for interpretation this time around. It won't stop some from just making it up as they go along but it'll be nailed down even tighter.

I suppose everything can be termed a technicality where rules are concerned.

Did we adhere to their rules or not is what CAS looked at.
Our view would be yes to the main charge and just a technicality on the one worthy of a fine.
They see us as guilty of the non cooperation but getting off on technicality for the main not guilty part.
Just words.
 
So I am currently making my way through the 25pages.
On Page 12 of the full award CAS highlights the following:

  • The failure of UEFA even to investigate these repeated breaches of confidentiality, let alone to take remedial and preventative measures, notwithstanding that the Investigation, adjudication and present arbitration continue (and despite MCFC’s repeated requests for such), casts grave doubt upon the fairness, impartiality and integrity of the IC’s approach.

  • ➢ Furthermore, the IC’s Referral Decision was made improperly and prematurely, in breach of the Procedural Rules, MCFC’s legitimate expectations as to both the substance and procedure of the Investigation, and the IC’s obligations of good faith and due process:
(a) pursuant to Article 14(1) of the Procedural Rules, the IC is empowered inter alia to issue a decision to refer the case to the AC expressly only “[a]t the end of the investigation”. The Referral Decision itself states that the Investigation is still ongoing. The IC acted in breach of the Procedural Rules by issuing the Referral Decision before concluding its Investigation;

Looking forward to finishing this full award, but this is telling from CAS how unfair and bent UEFA were when they were supposedly investigating us.

SHAME ON YOU UEFA, and to all the MEDIA .....DO ONE!!
