CAS judgement: UEFA ban overturned, City exonerated (report out p603)

Very disappointed that my curiosity got the better of me. Such a lack of understanding of the subject matter it is truly astonishing. Especially now.

Ewan MacKenna talking about coming on here actually.

Do they explain what a "farcical verdict" is, given neither has any sort of legal education, neither has seen the full award, and neither has any insight into the tribunal?

Ewan feel free to reply when you read this.

No, this is the failed attempt last year to stop the process before the ban was dished out I think. Some nice comments though

the Referral Decision is based on a flawed Investigation, which was not conducted with procedural fairness or due process. In particular: (i) the IC failed to comply with relevant Procedural Rules and ensure fairness in its treatment of MCFC; (ii) the IC repeatedly failed to respond to requests for information by MCFC; (iii) the IC made the Referral Decision prematurely and before its Investigation had concluded; (iv) the IC did not afford MCFC equal treatment with other clubs which it has investigated, including by making allegations in respect of matters prior to the current monitoring period; and (v) the IC breached MCFC’s rights to a fair and impartial judicial process pursuant to Article 29 of the Swiss Federal Constitution and Articles 52-58 of the [SCCP].

No bloody wonder we were confident of winning.

That's just a summary of our arguments about procedural unfairness as set out within the first appeal. Given that we were found to have not co-operated, it's unlikely that any of that forms the basis of the decision in the second appeal.

Worth noting that CAS threw grave doubts on the impartiality of the IC and doubted that City would get a fair hearing. (Look up their actual words, very damning) In a criminal court, as opposed to an arbitration panel, that would be enough to throw out all the 'charges'.

Now that would be interesting, strongly suspect he’d be way out of his depth. Bring it on!

Surprised pinto has had an accident in jail yet, surely he didn’t act alone or was asked to hack certain organisations by people unknown..

My opinion is that somebody gave him all the information.

Professionals together with people with inside knowledge of the football business hacked City.

Pinto is just an alibi.

Client > Hacker > Pinto/Footy leaks > Der Spiegel > Public domain > FIFA/UEFA/FA/PL

That must be a possibility. Qatar?
The idea that an impoverished student could afford the software, hardware and running time to pull off one of the biggest hacks of all time and did it all from a back bedroom is just ludicrous.
