He's actually quoted as noting that there's no time-barring or CAS appeal route, so the case is stronger by virtue of not having the limitations. That seems reasonable as a statement, and the Mail have twisted it to get their headline - it says nothing about the strength of evidence.

If a regulatory body had been put in place could the PL have charged us, or would that be up to the regulatory body? And would the regulatory body (when in place) have the power to quash any charges, if we provided them with conclusive evidence?
