PL charge City for alleged breaches of financial rules

Obviously haven't read all 1000+ pages (!) but there seems to be a debate over whether an appeal to the High Court would be possible (if needed).

I'm no lawyer but I thought I'd research the options.

Under PL rule X.37 "Challenging the Award", it specifically forbids any legal appeal on a Point Of Law.

However, with reference to the Arbitration Act 1996, the PL rules allow legal appeals for other reasons, such as :

- Insubstantive Jurisdiction.
I don't think anyone can argue that the PL don't have jurisdication in this case.

- Procedural Errors during the hearing.
I doubt the PL's own expensive lawyers would be that stupid, although I'm sure our lawyers will be watching their every move.

It's under Section 68, "Serious Irregularity", that things could get interesting.

I'll replicate the wording of S68 so people can read for themselves. I'm sure we'll all have thoughts on how some of these clauses could apply themselves to the way our case has been handled, evidence obtained etc.

"Serious irregularity means an irregularity of one or more of the following kinds which the court considers has caused or will cause substantial injustice to the applicant -

(a) failure by the tribunal to comply with section 33 (general duty of tribunal);
(b) the tribunal exceeding its powers;
(c) failure by the tribunal to conduct the proceedings in accordance with the procedure agreed by the parties;
(d) failure by the tribunal to deal with all the issues that were put to it;
(e) any arbitral or other institution or person vested by the parties with powers in relation to the proceedings or the award exceeding its powers;
(f) uncertainty or ambiguity as to the effect of the award;
(g) the award being obtained by fraud or the award or the way in which it was procured being contrary to public policy;
(h) failure to comply with the requirements as to the form of the award; or
(i) any irregularity in the conduct of the proceedings or in the award which is admitted by the tribunal or by any arbitral or other institution or person vested by the parties with powers in relation to the proceedings or the award."
I’m no lawyer but even as a layman I can see enough there for Pannick and co to work with.
 
My understanding is that ex-City employees were able to access City's "Scout7" system on a number of occasions after they had joined Liverpool. If that is correct it might not be what is considered a classic hacking attack but does show poor practices in the IT systems. Any access should be revoked as soon as it is no longer needed by the individual to perform their job role and some form of multi-factor authentication should also have been implemented with the token handed back or disabled once the individual leaves.

I will concede that no IT security system is unhackable I think it is fair to say that with a best practice security policy implemented, enforced and regularly updated it would have been far harder for Pinto to gain access to City's emails and he may well have moved on to easier targets.
Now I've stopped pissing myself (not at you), this is a true story.

A few years back one of the higher ups clicked on a link in an email that they shouldn't have, asking for new payment details. This gave them a number of valid emails and names to work with and we've been plagued with them ever since.

We had another one this week with an attachment and all employees were warned on Tuesday not to click on the link included. This warning came from our IT guys (the top one at that) and included it's own link which seemed odd. I wasn't in until today so asked about it and it turns out that the link included was the actual malicious link which was now available to every single employee rather than the small number who did receive it. I have no idea (nor do the company yet) of how many people did click it or what the consequences are going to be. Whoopsie.

That's how easy it is sadly.
 
It’s been a shit few days blues. Now it’s time to stand tall again and be proud of our club. It’s all going to be ok. Emotional ups and downs but we will prevail. The media should be ashamed of their behaviour. We have no friends in this fight.

This guy is exactly the right fit for City. A Catalan. The underdog in a social and political struggle against Spanish dominance.

Given his background and his allegiance to his home region, he absolutely gets it. I’m reminded of the yellow ribbon he wore a few years ago. What a tribute to him and his beloved region it would be if match goers started to wear the yellow ribbon?

I love and admire this man.
 
Trust the club, trust Khaldoon and Shiekh Mansour. Pep does so we as supporters should as well. After the initial group wank by the media and other team’s supporters welcoming our demise on Monday, when you cut through all that noise and bullshit and listen to the proper legal talk about these allegations. What the premier league is suggesting is there was wide spread collusion by our directors, our auditors like BDO and Deloitte and our partner organisations and sponsors on a grand scale over a ten year period. The Premier League are trying to do a Hail Mary on this which is going to explode on them and have wider repercussions for top level football.
