PL charge City for alleged breaches of financial rules

So it is mental to assume that there is discussion within the club about the outcome and Pep may have let this slip out with his wording. He may for instance have been told that we believe that all the major allegations have been disproved, but we are expecting a nine point deduction (sentence) from the less serious charges. This more than likely would put us out of the Champions League for next season. I believe they are going to get us on something and the power of the Premier League and the Cartel clubs will mean that some sort of punishment is issued. I hope I am wrong. Unlike many of you, I am not so hung up about what are owners have said regarding the allegations. The rules are an ass and verdict will more than likely be a fudge to suit all parties, to some degree (small or large). Let's not have our head in the sand and think about the financial and football implications of a limited finding against us. So get behind Pep and the team for the Real Madrid game, as this will be a massively important game in determining how hard they are able to hit us financially in the more immediate time frame. If you know your history, they were successful in destroying our 1904 team and my hope is that they have limited success this time (but I don't under estimate the forces against us).

On top of that, if all of the major allegations are disproved, how would we get a point deduction? For not cooperating? Absolutely no chance

I'd like to think so of course but I don't know. But what I do know is that initially, when the charges were announced just two years ago, I thought that these were very serious issues. After a few days, when I'd thought about them more and gone back through all the source documentation, I was much more relaxed.

In the last 3 months or so, after the APT case and re-reading the CAS verdict, my view is what I expressed and that you responded to. I think that what looked like the most serious potential issue is actually nothing.

As I've said (and Stefan doesn't agree with, which is fine) I reckon the sponsorship stuff mainly boils down to the issue of whether Etihad & Etisalat are related parties that we should have disclosed in the published accounts. That was mentioned in the CAS verdict and appears to have been the driver in the APT rules that we're challenging.

The fact that the Etihad sponsorship was deemed fair value by CAS (and also by UEFA back in 2014) means that this is unlikely to be successfully challenged by the PL, alongside the issue of it being disguised equity investment. I can't see any way those outcomes could be disputed by an independent panel. So if the sponsorship was fair value, and properly accounted for, what's left? Related parties is the answer.

And if it was fair value and properly accounted for, what difference would it make if Etihad & Etisalat were related parties? None, other than we and our auditors would be judged as failing to recognise them as such. That would make zero difference to our ability to spend money and gain sporting advantage, but it would force us to declare the value of the contract, plus we'd be guilty of a technical accounting issue. So there could be no points deduction on that basis, and that's nearly half the charges.

I spent the afternoon with a journalist before the Chelsea game. He writes for the very prestigious New Yorker magazine (NOT the NY Times) and he's an Arsenal season ticket holder. So I went into this a bit nervous, given the mentality of Arsenal fans. But even he said the charges appeared to be theatre, rather than having any substance. David Conn, whose tune changed completely once the CAS verdict came out (probably under editorial orders) dismissed the original UEFA charges as not having any substance. And he was quite right.

Since that initial shock two years ago the scales have dropped from my eyes more and more. These charges are baseless and completely without substance.

Fucking mental that people are jumping on a single word spoken by someone who plainly fails to express himself clearly and effectively when talking about these charges.
He used the word "sentence" previously when he clearly meant judgment. Plus he will know whatever the verdict from the liability hearing, sanctioning would come later (if The Lawyer is correct and they usually are). If anything, the way he said he would have his say, suggested confidence.
 
We were told the ruling involves a process. First the findings/verdicts will be announced. It was anticipated by the itk peeps (eg @slbsn) that whoever has come off worse will appeal. That could take months. Then, after the appeal outcome and if relevant, any sanctions would be announced and these could also be subject to appeal. So unless the itk were actually wrong, it can't be done and dusted within a month.

I was gonna say but the loser would need to have a legal basis to appeal but we’ve seen with the Leicester case the PL will appeal regardless and the Red Cartel will want to drag this out.
 
Listening to keown on the city game, he talks about how good it is without VAR (foul on a city player). Or how it isn't "fair" that their goal goes down as an own goal.

It really makes you aware of how rules and laws mean nothing to these people when it comes to the jealousy and hatred for City.

Top 4 probably irrelevant this season and a year out of Champions League can be withstood financially. Club World Cup money, which is rarely mentioned, will help support finances in this short term time period.
Priority for the club therefore is gaining money through Champions League and Club World Cup this season. Need best possible finish in both and maintain Premier League position so that points deduction avoids relegation. If verdict avoids potential for other clubs to take legal action against City for lost revenue over past seasons, the club can move on and the future looks positive. The Real Madrid game therefore is key to maintaining financial stability in the short term and Pep will see this as a defining moment for his legacy at the club, with the potential to keep City in the best possible financial position to compete in the future.
It sounds like you have read and believed every single media report on City. Sad for a City fan.

And it doesn't make any sense. The idea that he is so well informed that he knows what the judgment will be, but simultaneously so badly informed he doesn't know sanctions aren't even being discussed at this stage is just a nonsense.
