Advice needed regarding domestic right of use.

Its this 'right of use' i can't find a clear definition regarding this, my daughters solicitor thinks she could have a case, but she is shit :)
If anything you could argue she is affecting your daughter's right of use of her own garden.

Don't know the specifics tbh, but I have only ever seen those types with right of access.

It is at the end the day in her best interest too not to be a prick about it. Hopefully some sense is there

Agreed, hopefully it will be amicable.
 
Tell your daughter to "ask" next door could the please move your bins as we are planting a cottage garden up ,and need the space, trust me as someone who has fallen out with next door neighbour for the last 10 years..

Your daughter’s neighbour appears to be claiming what is in law described as a prescriptive easement (Google it)
Essentially, do something on someone’s property for long enough and you get certain common law rights
Not a leg to stand on unless she has been doing this unchallenged for 20 years. And even then it can be challenged
I knew Gray’s Land Law would come in handy one day
 
Shocked this has got to 4 pages and nobody has got close to the correct answer….

You need to wait until the neighbour puts the bins on your daughters lawn…..take a huge dump in one of them….fill up with toilet tissue and newspaper….set alight, then launch said bin through neighbours rear window…
