Hacked emails can be used as evidence, even in a court they can if they are relevant to the investigation except UEFA isn't a court so that doesn't matter.
How can you validate those emails after such a security breach when the system (Mimecast) required to do so was only purchased as a direct consequence of the alleged hack in 2016?

The newsworthy items:

1) Pep staying for the short term at least
2) Dan Roan's claim in his BBC Football article that:

"There is no guarantee City will be granted a suspension of their ban when they apply for it in the coming days at the same time as any appeal. The decision - made by a Cas official - will be based on an assessment of the merits of City's appeal, so this initial decision will give a strong indication of their prospects."

I had assumed that the appeal was a certainty and had not thought that CAS might throw it out at the first instance.

Filing the appeal, and CAS taking the case and suspending the ban will be the first hurdles. If we get over that much of the pressure that a hostile press has sought to apply will be alleviated.
 
Not sure about this. Was City's dossier on the list of material they submitted?

I am unsure myself as well tbh.

No idea how this irrefutable evidence ended up not being considered by UEFA.

It is clearly going to be part of our defense though,there is no doubt about that.

Whilst UEFA allege we failed to cooperate with the investigation.

Maybe UEFA thew the "Failed to cooperate" out there to cover the fact they refused to accept it.

UEFA might say we never offered further irrefutable evidence.Nothing would surprise me with those corrupt bastards,

It's just that where "we don't know" you're eager to fall on the opposite side to city.

Your not wrong, I'll try and explain myself if I'm allowed to. I want the ruling to be overturned like we all do BUT what we do know is despite UEFA's opinion of us they surely have some grounds for the judgment right? all I'm trying to do is provide an alternative view point but many on here think that I'm not a real fan. I am but in recent years we haven't had much to moan about have we? we have all been there haven't we over the years? typical city and all that. Even when things are going well there is always something in the back's of our minds as City fans that remember what we used to be like as a club. Even when we won the PL for the first time we thought we'd messed up again when we were losing to QPR.

I've always looked at things from the opposite side to avoid disapointment and if it all goes well then I'm pleasantly surprised.

Based on CAS’s statement last week, in which they said City’s concerns about UEFA’s investigation were “not without merit”, it is very unlikely they would simply dismiss the appeal.

It would also completely subvert the concept of a civil appeal process if the economic and operational penalty can be imposed before the full appeal process is exhausted (as the mere initial implementation could exact irrevocable and long-lasting damages on the party appealing; not that UEFA’s decisión itself wasn’t meant to do that, but we may have recourse to sue for damages in that instance, as well).
