I'm 20 pages behind. Is it all about stupid people saying Harris is stupid?

City launch legal action against the Premier League | City win APT case (pg901)

By applied retrospectively, that presumably means that any existing interest-free loans should start to be given a value from the implementation of new rules. The alternative would be that that value could have accumulated since the loans were made - but surely better to say that would be unfair...

City launch legal action against the Premier League | City win APT case (pg901)

If we wanted to "escalate"... City as a shareholder could always bring a claim against the directors, under s.260 of the Companies Act - or, given the evidence before the tribunal, under s.994: Petition by company member (1) A member of a company may apply to the court by petition for an...

The PL just didn't think about the side effects of FFP.

City launch legal action against the Premier League | City win APT case (pg901)

We're getting almost into another thread, about the structure , governance and probity of the PL board. As for FFP, I wonder if normal competition rules are inadequate for sports. What would stop a Musk spending billions on one team? Or several teams. Stagecoach did predatory pricing to take...

    The Labour Government

I know it's different when you're in power but Shapps went "rogue" and even Johnson didn't sound keen on what P&O did, but Starmer’s problem here is... well, what Starmer said at the time.

Non-exec just means not an employee. Non-execs vote for board decisions but executive directors carry out board decisions. She's had a senior role at Sky and is still a non-exec at BBC Commercial. I can't find a remuneration report for the PL but she got £140,000 pa from Nationwide before she...

City launch legal action against the Premier League | City win APT case (pg901)

APT is null and void. Possibly City may now argue that leaving debt out of the rules was a "by object" favouring of clubs purchased with debt.

City will get most of their costs from the PL. PL will have to pay their own.

The greater risk is a failed transfer that leads to a points deduction and relegation.

I wonder if the offer by Arsenal to draw up new rules, and the influence generally of the red cartel (and others) might open up a second front. Is anyone from the red cartel effectively a shadow director of the PL...

City launch legal action against the Premier League | City win APT case (pg901)

I can't believe so many eminent lawyers are actually getting this wrong. I'd not employ Simon Leaf if that quote is still his opinion rather than a "knee-jerk" comment without fully reading the tribunal decision. I suspect that 4 days on, even Delooney is less sure about the unanimity of lawyers.

City launch legal action against the Premier League | City win APT case (pg901)

Very comprehensive. A couple of observations, if I may. "City's objective is stated in the decision at paragraph 4. City sought a declaration that the rules concerning APTs were unlawful and an order that two decisions of the PL board concerning APTs in which MCFC have tried to participate were...

No, the "akin to a buyers' cartel" referred to the cap on football agents’ fees in a different case. (#225) The Tribunal rejected City's price-fixing submission. We reject the argument that the FMV determination process is an object restriction that involves either price distortions or price...
