City launch legal action against the Premier League | City win APT case (pg901)

Yes precisely. It is self reporting in the sense that any company that enters into any RPT will self report , but as you say it’s not a concept that is specific to football. And in almost every other field of human endeavour it appears to work.

City launch legal action against the Premier League | City win APT case (pg901)

Maybe, but I’d have thought even a half hearted challenge raises serious questions where the evidence is as flimsy as that!

Or, Portsmouth was just a pretext for those who just wanted to make it harder for us…

City launch legal action against the Premier League | City win APT case (pg901)

I agree the tribunal probably thought they had bigger fish to fry, but City plainly did challenge the explanation of why the new rules on APTs were introduced. What surprised me was that these apparent concerns the PL and the clubs had about why the previous RPT rules were ineffective was given...

Except that calling in shareholders loans was precisely what fucked Portsmouth. Which according to the PL was what motivated the changes in the first place. So is it not that much of an issue after all? And if you’re right that it’s not that much of an issue have you applied your mind to (a)...

City launch legal action against the Premier League | City win APT case (pg901)

Yes. The matters relied on by the PL are outlined at paras 17-18 and explained in more detail at paras 180-185. I don’t read the “misplaced” issue as referring to anything other than Portsmouth

I did. You just didn't understand it. :) Anyway, you asked me (in a post I can’t now find) what I thought about the introduction of the APT rules in the first place, and how the tribunal had viewed that. The answer is quite a long one. Let me start by summarising the evidence on which the PL...

Cracking post. Deserves more than a “like”!

I do think it’s an issue actually, and the move from the ex post system where there were notional adjustments for accounting purposes to the ex ante system where you need prior approval from the PL before you can even enter into a contract with a third party seems to me to infringe fairly basic...

If you want to come into my house not only do you have to take your shoes off, but so does your friend. And if he doesn’t want to you still can’t come into my house.

City launch legal action against the Premier League | City win APT case (pg901)

The right is that if a club wants to play in the PL it must abide by the PL rules. What right do I have to tell you to take your shoes off? None whatsoever unless you want to come in my house.

I think you are drawing a distinction without a difference. If something is void it is as if it never happened, but that is not to say it did not actually happen. Suppose two thieves agree to split the proceeds of their crimes 50/50. One steals more than the other and wants to keep it. The...

City launch legal action against the Premier League | City win APT case (pg901)

thanks for that. A few posters seemed to be unsure what “set aside” actually means so it’s just a word to explain that. I don’t think you can say there are no APT rules. The rules exist because they were voted on by the requisite majority of PL clubs. The rules are unenforceable because they...

City launch legal action against the Premier League | City win APT case (pg901)

I don’t agree. Liverpool have a good chance of winning the league, but they probably won’t. If the opinion was that on balance the rules were probably lawful it would have said so. It wasn’t a foregone conclusion but that opinion is an absolute giveaway that the rules were considered to be...

City launch legal action against the Premier League | City win APT case (pg901)

Having (finally) had time to read and (partially) digest the judgment, here are my thoughts for what they are worth. First, I sort of get why the PL took the stance they did, and why some posters and commentators have called it something of a score draw. The bottom line is, if you strip it down...

Rounding error? Sure you weren't thinking of Neil Custis? He's pretty round and he's usually in error.
