But it's not rape, it's been stated on here that legally consent cannot be given if under 16, so in a black and white world yeah it's rape, but if he girl says she's 18+ and consents then in Adams eyes consent was given to have sex with an 18 year old, barring carbon dating her whats he to do(assuming he didn't know her true age)tho it has been pointed out to me that Mr Rix was in a similar situation and he got 12 months for having sex with an underage girl, not rape...

But the law states that nobody under the age of sixteen is able to give legal consent to sexual activity.

I'm not saying it doesn't, but it's still not rape, unlawful sex yes, rape no, anyway without knowing the details it's all just up in the air, what's for sure is he will get jail time wether she consented or not...

If this even happened, she didn't consent. 15 year olds cannot consent. It's rather infuriating that people cannot understand this and I mentioned in the Cellar recently how these sorts of cases get given bullshit names and excuses towards them instead of what they are.

She may not have been raped as there's a legal distinction on the 14-16 bracket that means that implied consent comes into play. That's why some people get labelled with raping a child and others get labelled with unlawful sex depending on circumstance according to the Sexual Offences Act 2003. You can rape a child over 13 but not all sex with children over 13 is legally classified as rape. The system has protection for common sense built into it at various places

If the club were happy to admit her then she must have looked old enough, if she's used false ID and lied about her age then although he was maybe sniffing around girls in his mind 10 years younger than him its not all his fault.

As that is his charge, according to police as well, it must have been established that there was "reasonable belief of consent"

Where has this mythological nightclub senario come from ? I know from experience in town that clubs are really strict nowadays with ID. Some of my 26/27 year old friends can't get in anywhere unless they produce so I don't see how a 14 year old even dolled up to the nines would get away with it.

Had been picking this local girl up for about 3 years,from the Glasgow clubs back to Erskine.
Got to know her really well ( nothing pervy btw ), nice lass.
First name terms etc.
Picked up her pal this night,she asks if I'm working on Saturday,as its ***** birthday....she's 18..on Sunday having a do at her house,then all going to a club in Glasgow.
I said...."em...yeah I'm working...I eh might see you then"
I couldn't fukn believe it tbh.
I thought she was at least 19/20 when I started picking her up.
AJ is innocent until proved guilty,so let's not be judge & jury.

He's been charged, not sentenced. It could be totally unfounded and the police being overcautious given the current climate. If he's guilty then I agree, obviously.

The only people to mention clubs are on here, I haven't seen anything that states he met her in a club.
