Attempted murder is about the hardest criminal offence to prove, as the jury needs to be sure that the defendant intended to kill the )non-deceased) victim, no such intent to kill being required to prove a murder to the prevailing standard. And the alternative for juries is always s18, which has a maximum sentence of life anyway. It’s not like an acquittal based on a failure to prove intent to kill means a walk out. Anyone guilty of s18 as an alternative to attempted murder is looking at a starting point of fifteen years, will serve ten. That’s a long stretch.

Nothing in that clip looks remotely like attempted murder, but Brazilian law will be different.

Still a bit nuts, though!

He'd be unlucky to be even convicted of ABH in this country.I doubt very much he'd receive anything more than a suspended sentence,maybe some community service and a bit of compo.
 
You think such would receive a custodial? If previous good behaviour?
In this country? Yes. 100%. Kick to the head to someone on the ground? All day, whatever the damage. Certainly anything ABH up. Got to send out a detergent message to anyone contemplating such a (on the face of it) cowardly act.

Great to hear that,as it would appear from the outside looking in that courts are being incredibly lenient,with farcical sentencing,for serious incidents.
