City launch legal action against the Premier League | City win APT case (pg901)

But, FFP/PSR itself was not challenged, only the APT/FMV element, so that was not really considered by the tribunal.

I would have thought there may be potential to challenge current FFP/PSR on the basis that by object it is designed and has the effect of keeping the rich rich and the poor poor with no realistic prospect of any club outside of the 'big 6' ever bridging that gap.

I think it's pretty clear that PSR rules are a restriction on competition, it's whether that restriction would be deemed to be in the public interest that would be likely to be determinative if any club does eventually challenge the rules as a whole.
We won’t challenge the rules as a whole, imho. Too complex and time consuming, for what? We will see off the APT thing and then concentrate on 115.

And they benefit you, ultimately. I don't think we (Newcastle) will challenge them either, as we seem very keen to appear to be playing by the rules. I think it's more likely to come if any club is actually relegated as a result of a points deduction.

But the rules are illegal.
Now is the time to stand side by side with City.

I do 100% and we will benefit from City demonstrating that the current APT rules (specifically designed to stop us from growing) are unlawful. But the PSR rules do currently benefit all of the 'big 6' clubs, including you, which is maybe why you didn't really attack them from that angle.

I’m surprised the vote is going ahead at all.

PL must be under lots of pressure from yank owned clubs and others like Brighton because of the implications for them with interest free loans etc,

Doesn't make their decision right though when the panel already deemed illegal elements within their proposal.

I'm hoping that they get severely bollocked for wasting time and trying to force through illegal elements, if the tribunal has the powers/authority.
