It probably doesn't make a difference to that, the proposal is just going back to the old rules (with shareholder loans added to the FMV assessment) anyway.

The unlawful element is the proposal to not apply FMV retrospectively to shareholder loans, when PSR is by its nature retrospective, but that doesn't really directly affect City. It also seems unwise to change the rules before getting the final decision of the tribunal.

It's just not what UK based fans either expect or want. Imagine it before a City game. The stands would carry on being empty until just before kick off because 50,000 blues want to get the beers in before the match. All that glitziness won't look good in an empty stadium.
