The father in law died last week, seems he was in debt on a few credit cards his wife knew fuck all about. We seem to think that these credit cards are in his name only, so does the debt die with him? We thought the house was in his wife’s name only but it looks like the sneaky bugger got his name on it (it was hers before they married and it was intended on her death it would be passed to her two daughters, one been my wife). I have a feeling there more debt to uncover, how do people go about finding this out after someone’s death? I may sound awful but we never liked the twat anyway plus he was a rag which I instantly disliked him straight away.
 
Get yourself a solicitor who specialises in wills, death and estates. Sounds like it'll be a bit messy but they should be able to do all the spade work and retrace his actions.
 
Family members do not inherit the debt however, his estate has to settle them. Whoever (his wife) who is dealing with his death would be expected to sort it out.
If he has his name on the house, that is part of his estate so the companies/banks could make a claim against the house.

One idea maybe is for you, not his wife to inform the banks and credit card companies of his death and see if they pursue the debt or write it off.

One thing i would question. He could not have put his name on the house without his wife knowing. Legal documents would have to be signed by her and Land registry informed.

At least you can take solace in the fact he died having to watch the rags being absolutely shite. May have even contributed to his eventual demise.

You make it sound like he got his name on the house without his wife knowing, that just isn't possible if she was sole owner when they met, she has to have signed a document to make that happen. If half the house is his it becomes part of his estate which can be used to settled his debt.

It sits within the estate and probate will sort it all out. Inconceivable that he was sneaky and put his name on her house. Cant happen. What do you mean by that?

Ye sorry for the confusion, she did know about him getting his name on but no one else did and she specifically stated years ago it would not happen, I think he’s persuaded her and then got money on the basis of owning it. His wife is the executor of his will but tbh she’s bloody useless and doesn’t seem to want any advice, this was more to stop my wife getting stressed over it all and her mum ending up in lots of debt because of this twat.

How could they claim on the house, she has zero money to pay any debt off would they make her sell it?

I have to say I am not a fully qualified solicitor but given the sad situation you have described, could the lady mentioned not smash in the back doors, set fire to the place & then claim on the insurance?
