I have just recently been cleaned out completely.
I had lost my bank card on a night out in town, I have very hazy recollections of the circumstances but I remember going to withdraw £40 as I was running a bit low on cash, but noticed a chap lurking behind me, now I do not exactly remember what happened but I presume I have fucked off pretty sharpish fearing a mugging (Was alone and pissed) yet in my state I presume I left the card hanging in the machine, and he has seen my PIN lurking over my shoulder. Around 30 minutes after this £260.00 was withdrawn from a different cashpoint (PIN was used) along with around £30 spent at some fast food places I NEVER visit (Krispy Kreme's & some indian place) All this was done the same night (Luckily I have a £300 limit on cash withdrawals) As soon as I got home (early hours of Sunday morning) I rang up to cancel my card and request a new one (At this point unaware of the thefts)
Now the unbelievable part: The fucking dolt I spoke to didn't actually bother to cancel my card - and the fuckers have been on a shopping spree around town and have completely cleaned me out.
This morning on receiving my new card I was promptly declined at an ATM & went straight to the bank to enquire - went on to speak to the fraud helpline and explained all what happened pretty much as I have here. Was completely honest to the guy on the phone. I've also reported it to the Police. (Purely to get a crime ref# - don't give a fuck about prosecution just want my money back, they had the fucking gall to tell me they 'probably won't do anything about it' though)
Now since the in shop transactions are highly suspicious (Lots of declined attempts in expensive shops etc) and I actually rang to cancel said card before they happened. I'm pretty sure I'll get this money back, however on reading up on investigation procedures I was pretty horrified lots of cases where the correct PIN & card have been used don't get refunded, due to negligence on the customers part. I very naively told the fraud helpline I still have the PIN confirmation letter in my house - it hasn't been stolen or burgled (Pretty sure about that) but apparently they can use this as a reason to refuse to refund me.
So my question is, will I get the £260.00 and the £30 odd pound refunded aswell as the transactions made after I rang up to cancel my card, or will they dig in their heels and refuse ? If so, what is the next course of action I can take ?
I bank with RBS & haven't as yet given an official statement to the Police (They said they will be in contact)
Anyone with prior experience who can give me some reassurances/advice ? I hope they will just refund all the money as courtesy due to their major fuck up in not cancelling a card I reported as lost but banks are notorious twats.
