The rules are pretty cut and dry really, and he doesn't pass any of them, so based on the laws as they are it's probably the right decision, although it's shit for the kid.

The main test is based on international appearances in the last couple of years.

Then there's an appeal where you get points for transfer cost, wage cost, whether you've player in continental competitions etc.

That article explains them very well. He failed the Main test, failed the appeals procedure and was left hoping for an exemption.

Also @St.Pauli support, the public not being told is not the same as the work permit process lacking transparency, for all we know City might have a very thorough explanation from the panel of why they turned him down.

Well he was a big get for them so they probably put him in the top 25% of their wage earners, that gets him 3 points.

Fluminese are in the top division of Brazil and he would have played well over 30% of their games in the season before he joined Everton, that gets him 1 point,

His participation in the previous seasons Copa Libertadores gets him another.

So he gets at least 5 points, which means they recommend a work permit.
 
I imagine a work permit would have opened more doors for a better loan. Akin to Mooy.

Gundogan, Delph, Gomes, Zinchenko and potentially Stones can play there

Gundogan isn't a DM, Delph - maybe (looked great in midfield for England), Gomes - maybe (don't know much about him), Zinchenko isn't a DM & Stones is a great passer for a centre back, but probably isn't good enough on the ball to be a Pivot.
