The contract situation seems unclear. If he left , gardening leave or not then as per normalIt's getting to a point where City has to pay up or move on. We all know Chelsea will not play ball and wants full composition because he still has 3 and a half years left on his contract.
If City feel he's the best option, then get it done ? It would be the same if we wanted a manager who's in a job.

Manchester City are continuing negotiations with Chelsea to appoint Enzo Maresca as their new manager.www.bbc.co.uk
It'll be sorted in due course.It appears from the outside that the ball is very much in Chelseas court. They know we've chosen Maresca and now that Iraola is out of the picture as a possibility it will have strengthened their hand a little. They fell away when he left and they'll figure in some compensation that we'll have to come up with for them missing out on CL. Chelsea will likely be in no hurry and will be happy to wait to see what their lawyers recommend. It's all a bit of a mess really. Hopefully it'll be sorted out soon.
