He wins if he's guilty, the US wins if he's guilty but they don't have the evidence to convict.
I suppose it's a draw if they have the evidence but the trial would be in a state that doesn't have the death penalty.
There might also be issues about his mental state if he's been held in Guantanamo without trial for 20 years. A plea deal stops this being aired.
