Kids riding bikes on "private" estate

The thin end of the wedge.

Today two extremely polite young lads on their nice shiny new pushbikes.

Tomorrow a gang of fat beer swilling Hells Angels from the Moss side chapter burning up rubber on their Harleys, doing wheelies on this bloke's drive and posting excretia through his letterbox.

Give people an inch.......
 
In a situation like this, put yourself in his shoes. Would you want a couple of kids and he doesn't know they're little angels, on your £1m driveway.
They aren't on his driveway, which is gated and secure. If they were he'd have a damn right to get them off. They are on a road which runs past his house and lots of others.

Honestly, I'm not looking for people's opinions on the ethics of this situation. I'm quite happy with that side of it. I just want to know where he stands legally in case things get heated if it happens again.
 
Legally? Not a leg to stand on. As long as they are not on his property then all good.

I don't understand why the good people of bluemoon cannot answer this question, can the kids ride in this area which is either public or private. if we can't legally give sound advice based on no information it is a poor show.
 
A private road is not necessarily a road without public access, and an unadopted road is not necessarily private property. It's unlikely he owns the road outside his house if he lives on a development. Ring the council highways department and find out the status of the road, and who has rights of access. Are there any signs on display?

Alternatively, knock on his door and show him your arse as your kids cycle past his house.
 
Public access isn't restricted and there are no signs saying anything, so I don't think vehicle gates automatically mean nobody can enter.

If I have a "discussion" with him about it my angle would be along the ethical lines, i.e. What harm are they doing? Rather than your classic English "I know my rights" fast track to the moral high ground. I'd just like to know my rights if he starts shoving the law up my arse.

I suspect that as you say, it's complicated.

How about other people's kids cycling in your garden cos it's safe?

If the issue arises, that will be my angle in a calm and polite way. Not that I'm planning on letting them run amok every night there.

It would be easy to jump on the moral high ground and start saying that it's the only safe place for miles, and my garden backs into the road, and it's better than playing on their iPads and all that. That's not really my thing, but if he did start getting arsey I'd like to have the legal facts ready and not get blindsided by some law involving gates or something.
