PL charge City for alleged breaches of financial rules

The restaurant has been open and serving food for many years. I know City have stated that APT rules are null and void, unfortunately for City they aren't the tribunal nor the PL and essentially what has been agreed is that some tweaks are required. One tweak is that the way APT deals are approved will be amended (although PL retains the ultimate decision of veto) and the other tweak will be to look at shareholder loans moving forward.

The whole FFP framework is due to change next year anyway regardless of the case.

The tribunal said APT in it's current form is unlawful. Nobody has 'agreed' that all that is needed is a few tweaks

My takeaway is there are no APT rules now, they are unlawful and therefore all null and void. If still wanted they will have to be reworked to be non discriminatory (i.e. not fit for cartel purpose in targeting City & Newcastle) and also fold shareholder loans into PSR from 2021 at a cost of millions to said cartel.

If it is true that APT is null and void because of the unlawfulness around soft loans, then the same can be challenged for the whole FFP framework presumably. This is an absolutely vital point to clear up imho and I am not surprised City are not going to let the PL off the hook easily.

Well whether they won the case or not those legal bills would still be there right? Due to the fact City went to court about it. And it wasn't a case of APT rules being enacted incompetently, City challenged them saying they were unfair (in particular the latest amendment about how these APT deals are approved and the l
process involved in that).

How much the rules will change as a result is yet to be determined - we'll have to see but my understanding is that 60% of PL clubs will need to approve any changes that do happen.

I guess if bills rack up and that cuts into PL clubs' income streams then the clubs have the right to demand a better way of working.

But for each case 50% of the bills are levied on City so the same applies to City as well I guess.

Perhaps a simplification of the rules that everyone is happy with would be the way to go rather than creating a complex legal framework that all clubs try to find loopholes in anyway (does anyone want to buy a hotel?).

My understanding is that City "Didn't take them to court" the PL took City to a tribunal

If something in a contract/agreement is unlawful, the court can throw-out the whole contract/agreement once it is shown to be tainted with illegality. The agreement can be regarded as void; it is set aside and the parties are restored to the positions which pre-existed the agreement.
If one tribunal has declared a part of the rules as unlawful, City will be looking to drive their bus through that unlawful hole again. The result this week was focused on APT's, but, how many other such holes can City identify? That remains to be seen, but, after the APT farrago this week, I'm sure there's a sense of "Pannick" setting in with the P.L. and their lawyers.

While I do think it could actually happen that a tribunal doesn't want to hear "new evidence" if it's rigged (remember how we worried about 3 pl appointed stooges before)..

I do think we have to kick and scream and make them look biased and then we can officially start a new case of them charging us with bogus rule violations.. and the rules not being legal in the first place..

Basically the APT thing.. give the PL enough rope or in this case the kangaroo court enough rope and they hang themselves.
