I've just made a trunk call and the special branch have twigged who you are,so you are stumped.

Unless it's the type of tree that will just stay standing for ever after it's dead and not the type that will eventually fall and cause damage/ injury, I would probably cut it down.

I think @aguero93:20 is in prison at the moment, so as he's not here I suggest torching it and lobbing bricks at it until it comes down
I haven't read anything anywhere that this is true in England. I have read previously that some councils put tree preservation orders on certain species though and that might specify a height.
Edit: My mistake, 5 cubic metres volume, apparently.
Edit2: It's too early. I think I was right the first time, if it's in your own garden without a TPO you can fell it but if it's over 5 cu metres you need a licence, possibly.
