I've got the bit between my teeth now. Probably posted more in the last week than in about the last three years put together.

As for them being able to 'cheat' and pursue the process now so that they have more time in any second investigation than they had in the first, no doubt we'll be arguing that this is one of the reasons why the process is now compromised and impossible to complete fairly. The danger for us is that the CAS may think that we have an eventual appeal against any second verdict on the merits, which sufficiently safeguards our interests and allows us to be punished if there is evidence of wrongdoing.

A further point occurs to me. If we indeed are arguing that there's no case to answer so the investigation should be set aside in its entirety (which I discussed in my first email this morning), it doesn't seem to me to be all that likely to prevail. However, if we present this argument convincingly, maybe we can persuade the CAS that, should they not send the case back for a new investigation, they aren't going to assist us in getting off when an investigation is nonetheless merited.

If CAS conclude that city are right and the IC failed to investigate to their own guidelines then with a limited membership of:

Egon Franck (Germany)
Petros Mavroidis (Greece)
Damien Neven (Belgium)
Richard Parry (England)
Konstantin Sonin (Russia)
Yves Wehrli (France)

The CFCB states the IC should be the chief investigator and least 3 members. Parry is excluded by the recusal article 9, leaving 7 members of which a minimum of 4 have already been involved in the investigation. I can't see CAS ordering a fresh investigation and allowing the cfcb to involve the same members from the first investigation, they would be leaving themselves too open for critics. I get the impression with it being a chance to go after city they would have selected the most high profile members and those with the greatest vested interest first time around which coupled with the Greek partial comment that not all the IC were in agreement would point towards it involving the German and Spanish member amongst the original IC investigation committee. Do you think CAS would allow UEFA to establish a new IC committee from the members not involved the first time and would Leterme be involved again with the power of a deciding vote in the event of deadlock?

More likely Granada will revive Crown Court.
