Why is leaking the details not even to get off on a technicality? Wouldn't that mean that they didn't follow their own written protocol?

It should all be done confidentially to ensure there's no influence on the decision. But leaking to the media in the way that they did wouldn't have influenced the IC verdict, as they knew all of that information already. What City could say is that we were unwilling to cooperate with UEFA at that time because we couldn't trust that private information submitted as part of our case would not be leaked to third parties.
 
It doesn't work that way at CAS. Leaking is irrelevant (although frowned upon) - some of the panel will consider it potentially indicating that UEFA did not act wholly objectively but it won't influence the final decision and certainly not be a technicality to dismiss the case.
In the appeal document you posted a while back, there was a section where city specifically mentioned something along the lines of City being let go of the settlement that was agreed for no investigating of periods 2014-15/2015-2016. Do you think this means that UEFA have released us from the settlement somehow or that they have gone against the settlement criteria and that's *one of* the things we are challenging? If they have released us from the settlement, it questions why we would agree to such a settlement in the first place if it could be dropped so easily, maybe our defence was not that good OR we have something on UEFA's behaviour that both agreed to keep under wraps.

City fulfilled the obligations of the settlement agreement so are therefore released.
