The club did ask (reportedly) about the process, but my understanding is that CAS won't be able to rule on anything unfinalised.


City involved CAS on the question of the legality of the Email, if CAS do not allow it UEFA are stuffed, so CAS dodged a reply now UEFA are in limbo the hard liners Tobias and Bayern want it to go through, but others look at the cost, as City now know they will take the case else where, which will cast a huge slur on CAS`s impartiality

You’ve missed the majority of the story.

City have officially filed a case against UEFA with regards to UEFA’s process not being fit and proper. CAS are reviewing the case but are yet to set a date for the hearing.

You are probably right, but you will find that the predicament CAS are in is the same and it still centers on the Email the process will probably be CAS`s get out
 
It is anything but an open and shut case. The evidence is based on a few seven year old emails which can be interpreted in many different ways and City have said they deny any wrongdoing 100 per cent. The emails were hacked by a person who has been charged with extortion after huge sums of money were transferred into his Swiss bank account. He is accused of hacking on an industrial scale, bigger than Wikileaks and the Panama Papers. This investigation has been escalated recently and involves several European police forces. To compound matters UEFA have made public comments that have prejudiced and undermined their own investigation. And don't forget that the emails relate to an alleged FFP breach which is historic and we have already been punished for. I believe UEFA don't have a leg to stand on and they know it.

I think City said their accounts are available.

That's a bit different from 'any wrongdoing' - I wouldn't be surprised if the claims are true (at least in part), but that they are also unprovable.
 
I think it's hilarious, the whole fucking shit show, put it simply, my role working for a 5000+ employee company in the UK is to find ways around legislation, nothing illegal in that, you follow rules and regs and when you can get round things by still following those rules and regs you should be applauded,not treat as a criminal organisation.

Yes, that's how it reads to me here. The allegation seemed to be that City found a way round them.

Not sure about that.
I'm sure it was reported at the time that the club 'appeal' on process was invalid at the time. I think it's because the whole UEFA sanction decisionmaking was still ongoing.

CAS will then look at the whole thing at the end, if the club appeal.

No, the club are appealing the process, and CAS are going to be judging the case. CAS issued a statement at the time, saying so.

However they can't judge something that hasn't been finalised, surely?
Until UEFA decide an outcome, there isn't anything to judge.
 
Wouldn't surprise me if UEFA self-sabotaged to get it thrown out on a technicality so they could say they would have punished but... and then the media can brand and tarnish us forever with "City cheated but snuck off on a technicality" and we therefore don't get to prove our innocence and force a very public exoneration.

The tarnishing and sullying of our reputation will be the lasting damage they're after, and denying us any chance to clear our name from their accusations is the best way to achieve that.

CAS aren't looking into that (yet, at least) but into whether the process itself was rushed and didn't follow their own guidelines. We're basically trying to get shot of it before the UEFA upper chamber come back with a punishment.

I suspect that City wouldn't leave it at that.

I remember that was what they were asked. I thought they'd said they couldn't.

Well we may not be able to get that far. If it comes down on due process where can we realistically take it? There'd be no judgement against us and bar the media leaks no evidence has been presented. UEFA can just release a statement saying "we are dissappointed with the ruling and re-affirm the merits of our case, whilst we accept the ruling on procedure and will review these in due course" and leave the field open to the reputational hatchet job. If the case goes down on procedural issues then the content of the case isn't being explored/torn to shreds.

It doesn't really matter though. Hacks are saying we're guilty now, they'll say we're guilty afterwards. It's not going away and there will be a legally acceptable way of saying City are guilty regardless of actual judgement, which will be used ad infinitum.

That was reported, but why did City appeal knowing it was too early, UEFA investigators bluffed on the evidence and hoped City would take it as a `hick up`, if it was just an appeal, City would have told UEFA they were GOING to appeal any punishment

I know, but that's the final bow in their arrow, just look at the FIFA reporting. "City got off" is their golden goose we won't be able to shut down. As a club we need nothing less than an exoneration.
