PL charge City for alleged breaches of financial rules

As I said in a previous post, I cannot see how City can have a fair hearing when every Tom, Dick and Harriet across the media has already pronounced us guilty and passed sentence.

There is a reason why, in proper trials before the King's courts, the media are not allowed to do this. Imagine being accused of (say) murder and every paper, every online source spent months saying how guilty you are and how you deserve 50 years inside. You would not stand a chance before a jury, which is why this sort of trial by media is illegal and called contempt of court. The judge would throw the case out of court if such a prejudice arose.

The process is a fucking disgrace.
It is, but has anyone ever stopped to think why would City continue to remain quiet other than their opening statement while allowing these jackasses in the media to continue running their mouths?
There will be a reckoning. Trust in the Club and enjoy our successes while we await the last laugh...

The commission isn't set up to find us guilty of fraud. We only stand accused of breaking PL rules. That's the only thing commission will look at.
If the rules they're accusing us of breaking require that we'd have had to committed fraud then they do need to prove we were fraudulent. Thank god some of you are not a part of our defense team...

This comment was made by Soriano in the FT during the uefa case.

It can easily apply to the league:

“The owner has not put money in this club that has not been properly declared,” said Mr Soriano. “We are a sustainable football club, we are profitable, we don’t have debt, our accounts have been scrutinised many times by auditors, by regulators, by investors and this is perfectly clear.”

Anyone doubting the club just needs to read what Soriano, Khaldoon said at the time. The case now with the league is pretty much the same…illegal owner funding!

There is no leak nor smoking gun. The financials can’t be interpreted any other way but correct and accurate.

If anything the Cas Verdict has given the club a dry run. We know how these tribunals operate now.

We can easily argue each point the premier tries to push on us with the evidence presented at CAS. How can you find the club guilty when CAS could find no evidence?

It’s going to be a beautiful day/week/month when the case falls apart and the media is foaming at the mouth. Might need to book a holiday once the all clear comes in.

There's no kangaroo court. The PL has appointed a commission to hear their allegations, and the commission is headed by a very experienced KC, Murray Rosen. He will recruit two experts to hear the evidence with him, and the PL will appoint counsel to lead their case. City have already appointed counsel to present their defence. There are loads of experienced KCs involved on all sides. It won't be a stitch up with a predetermined outcome.
What about the so-called independent panel for Everton, two of whom worked for rival PL clubs. They somehow agreed with the request by Masters for a 10 point deduction. Just naked corruption in plain view.

I think you are overreacting a tad here. We are in effect members of a private club - the PL - and we have to abide by their rules when we agree to be members. We can't go taking them to court because we don't agree with their rules. To change the rules, we would need to get a majority of fellow member clubs to agree with us and then propose a rule change.

We are at the stage of having been charged, and a commission has been appointed to look at the evidence. The next step could be years away, so there is no point worrying about it now.
But the PL keep changing the rules without any agreement with the clubs. The Everton sanction criteria was made up by Masters. This is a farce.

Can you give an example of an organisation getting billions for reputational damage?

Although admittedly no legal expert, unlike most on here, I'd imagine an organisation would have to prove some quantifiable loss to gain any compensation. Other than a few ruffled feathers I can't imagine Etihad or others could actually present a viable case.

Dominion Voting systems got nearly $800m out of News Corp / Fox.

Etihad Airways PLC...
One thing learnt from the EFC ruling is the level of resolution the IC are forced to document and publish in the public domain. So forget all the vague rule number quoting in the charges. They will have to say unequivocally that the executives of MCFC and Ethihad Airways conspired to falsify accounts and artificially inflate sponsorship fees. They will also have to publish the compelling evidence that proved the PL charge. In addition, Ethihad have paid over a hundred million to sponsor a PL and ECL team, not just an EFL team.
The idea that Ethihad would not have grounds to sue the PL is ridiculous. Same applies for Etisalat and Aabar.

They may also ‘finger’ Mancini and he would be in a position to litigate if he feels his reputation has been sullied.

Correct re the burden of proof However the KCs will want to be absolutely certain that the evidence is 100% correct it’s not some corner shop they are judging upon the people involved couldn’t be any more powerful and influential with stellar reputations The KCs have worked hard for their reputations and will not be prepared to damage them
If people think the IC is going to give us a fair hearing and punishment they are deluded.
Should they smash us with penalties then how will that negatively affect their reputation given that everyone out there thinks we’re guilty anyway. Make no mistake about it, they will hit us for six even if only foundry guilty for the most minor of offenses.
I am seriously uncomfortable that our fate is in the hands of these three individuals.
This needs to be looked at through the legal system, non negotiable.

Very informative and balanced article. Martin writes what most of us think and feel about the situation. A lone voice drowned out by the ferocious click bait pack. At least we know it’s not always bias blue thinking on our part.

Wonder how many points Master the red has recommended the independent tribunal to hit City with? Greed and jealousy by the red clubs has destroyed the league. All because they fear competition. This is what happens when you hand over so much power to those clubs.
Copy, paste, share this with every footy fan you know.

We need to mobilise...
