Benjamin Mendy | Joins Pogon Szczecin (p92)

Its not a charge, its a consequence. What happens is the CPS decide to charge. The police then lay then charge, and you get bailed to court. The courts then impose bail conditions. If you breach those conditions the police can take you back before the court, for breaching their rules. They act on what the court said. It isnt a new charge of a crime, its a broken promise that the court said you have to abide by in order to stay out before the trial is heard
it was dropped from that court appearance so it's irrelevent anyway

We must be at crossed purposes now. It wasnt. Why did he end up being remanded to custody then?
I might have mentioned this before, breaching bail conditions isn’t a criminal offence. So it’s literally impossible to be convicted of it. So any such charge is going nowhere. I reckon the system wouldn’t let you charge someone for an offence that doesn’t exist. At least you like to think so!

Jailed you wally. He was jailed for a long time.

Who you calling a fucking wally? I was talking about YOU. You said you'd be sacked if you were in the position Mendy was. I answered you wouldn't, you would possibly be suspended until the result of the trial was known. Once you were found not guilty, as he was, if your workplace had sacked you then you could take them to a tribunal. He was remanded in custody for a time for breaching his bail conditions. Eventually after a few appeals I believe he was bailed again.

I know this, thats my point, I was trying to explain it to the last fella

He wasn't "jailed" he was remanded in custody for breaking bail terms. There is a distinct difference, that said he was unable to turn up to work as a result, so for the period on remand I can't see how the club owe him a wage. No idea on the bonus side of things.
Breaching your bail conditions simply reverses the position on the presumption of bail. It basically means you can’t be trusted when you’ve been given the benefit of the doubt, even though you’ve been charged with a criminal offence. So yes, people who don’t comply with bail conditions, without reasonable excuse, should have their liberty removed.

If I was accused of a crime, and on bail, I’d make the fuck sure I complied with any bail condition(s). It’s got to be your main objective every day.

No excuses.

Logically you'd think as it was his own actions that led to him failing his bail conditions and being remanded into custody, then we wouldn't be liable to pay his wages during that time. I guess Mendy could counter argue that he should never have been in that position anyway as he was innocent. Complicated.

Yes. Staying out of the big house has to be your main objective. It was probably sheer arrogance of being a spoilt footballer used to getting his own way that made him not take it seriously.
