Also suspect, this second APT case would be abandoned if the follow on determination from the first case is that all the rules are unlawful (although I think this is unlikely). Not simple.

By having the second vote they have taken it beyond the jurisdiction of the first tribunal meaning they need two separate proceedings - whereas if they hadn’t had the vote they could have just amended the rules in line with the determination of the first panel?
