One of those things where you say it's a foul anywhere else on the pitch - he's kicked his foot, but referees generally apply a higher standard for penalties even if they say they don't... Only issue is that it definitely was inside the box, the referee just had no idea and you can't then say "oh actually no it isn't a foul if it's in the box".
