They're checking that the foul started before the ball was in play. Otherwise, it would be a penalty.

The ball wasn't in play. That said, if you ask me - anybody who isn't looking at the ball but is more intent on grappling their man, it should just be an instant penalty. Some of the defending these days looks more like the NFL.
