Aguero banned for three games (updated)

Personally i dont have an issue with him being suspended, it looks like an obvious one to me (totally ignoring the fact that fellaini should get one of these every week!). The problem is the ref, if he's not seen it like he says he has he should be taken back and retrained as it wasn't off the ball, he was challenging for the ball with the defender.
 
The thing is he could argue that although he had a view of the incident his mind was unable to process the finer points and so he failed to notice the offence. Which if true backs my position that it was probably a yellow card offence due to careless play (which looks far sinister when analysed in slow motion) rather than an outright premeditated assault which not even a blind man could fail to notice. The problem is that the ref is in a no win situation regardless of weather he says 1) He did not see(notice incident. 2) Saw incident and felt it was harmless and sticks to this opinion 3) In hindsight feels he made a mistake and thinks he should have issued a red. Now put yourself in Marriners position and honestly answer which response you would give.

He was looking at the incident and saw nothing wrong, this despite the fact that Reid was making the most of the situation. That means in real time, looking at the incident he didn't see an offence of any kind. That should be the end of the matter.

If there was intent and he was swinging his elbow at Reid in a fit of pique. He did a pretty f*cking crap job of elbowing the fella. If you want to know how you do it properly look at Fellaini and Rooney.

I just saw a player protecting himself and using his arms to hold off the player and he happens to catch Reid in the throat whilst Reid was attempting to punch Sergio. That would go in my report.
