Load of players use the 'Heart' celebration.
Isco did it twice in the U21 championship for a start.

The mark doesn't seem to offer much marketability in any case and the trademark was probably worth less than it would cost to defend and maintain its status.

It was only ever in respect of goods not the goal celebration itself, he put the 11 in it because otherwise it would have in all likelihood failed because it wouldn't be distinctive enough/ was too generic.

It is a bit sly but trademarks exist in much the same way that patents do, (the obvious difference though is patents will be exhausted after 20 years, where as you can renew trademarks) the authorities recognise the first to register a successful application not the first inventor or designer.
