If she'd actually accused him of it then yes, but she didn't claim she'd been raped. If it's overturned, the ones that should be answering questions are the police and the CPS for effectively deciding for her that a non-existent rape has taken place. I'll excuse the jury because they would've been swayed by the prosecution case.
