The Senate Judiciary Committee chairman has said there is “no hint of misconduct” by Supreme Court nominee Brett Kavanaugh in a confidential FBI report.

There is no evidence to support the accusation. You describe her as a rape victim but I see an accuser who cannot provide any details or corroborating testimony.

The FBI report is a stitch up. Surely you can see this? They never interviewd the accused or the accuser for a start.

This is the most openly corrupt Supreme Court nomination of all time. The guy wasn't even on the list until he proclaimed that a sitting POTUS should not be subpoenaed, or subjected to criminal investigation and now the GOP are falling over themselves to get him on the court. This is bigger than Watergate by a huge margin.

Mate, to be fair she's a poor witness no matter when it happened.

She can't recall some pretty key details, she named 4 other people as witness who all denied her story, and people who have known her well in the past say that she's misleading about several statements regarding her symptoms.

I also find this somewhat massively coincidental as far as timings go aswell.

Just based on facts alone, no matter how long ago it was, there's not much that a prosecutor could do with her on a stand.

So, 40 odd years ago I got the sh*t kicked out of me by my 'dad'.

I remember him breaking my mum's fingers, I remember him knocking me across the room when I went to defend her.

I don't remember what day it was, I couldn't tell you what time it was, but I could tell you it was upstairs. I could tell you it was daytime and I could tell you who was in the room.

Does this make me a poor witness if this ever went to court with the fact that trauma affects the brain acutely for different people?

Not all, just the ones who don't remember the details. You could supplement this lack of evidence with Doctor's reports, Police reports, other witness testimonies or whatever. Being a poor witness doesn't mean that you have a poor case.

Thus negating the point of a situation like Blasey-Ford, which brings it back to the point of your 'proof or it didn't happen' type argument, even though she had a lie detector test to underline her accusation.

What else does someone need to tell their truth about historic abuse...?

Polygraph tests can't be used in court because they're not accurate and very easy to beat.

I don't know if this is fake news or not as haven't had chance to look into it, but apparently Ford gave a lecture many years ago on how you to just that.

Anyway, the point here is simple - let's say that we just throw out lack of evidence as such an important part of a case, how do you judge a crime beyond reasonable doubt? Guess based on he said-she said?
 
I watched most of Kavanaughs testimony to the senate last week. I thought the democrats missed a trick in that there were a few inconsistencies there that they could have focussed on and also in terms of his character rather than trying to go after the big ticket of trying to prove his guilt for something that is almost unproveable.

As much as I dislike the republicans and wonder how he was the best candidate that Trump could put forward, Fords accusations, right or wrong, would never get through a court of law. It is ultimately one persons word against another. People can believe either side absolutely, but belief is neither fact or law.

Much like brexit here though, it has become a polarized debate where the democratic side will back anything against and the republican the opposite, regardless of how hypocritical or even, at times, trivial it becomes. Rationality seems to have gone completely out the window across all of politics and I'm increasingly finding both sides guilty of it.

Personally, I blame the rise of social media and the internet, but that's another topic!
