It's not up to Biden. It's up to the Judicial branch to bring any prosecution. The Judicial Brach is a co-equal branch of government, and if they consider that prosecuting Trump is a worth endeavour, then it's their decision, and their decision alone. Ultimately, Biden can chose to pardon Trump, but I wouldn't bet on it.Biden will not put #45 behind bars.

What makes you think Biden will break protocol?
It's a fact that if he doesn't pardon #45, every future Dem pres with a debatable career will be jailed too.
