If he was banned, and therefore ineligible, yet allowed to play, then Droylsden have fucked up royally. To be fair they've had a couple of reprieves anyway, they were gifted a goal in the 2-2 draw (there's no legal requirement for Chesterfield to allow them to score) and they 'conveniently' had floodlight failure whilst 2-0 down in the replay.

More in importantly when the suspension was issued and confirmed only game which fell between the period was Vauxhall on the 26TH. It is my understanding that re-arranged fixtures have no bearing in terms of suspensions as we have seen teams have failed to move fixtures (Havent & Waterloo last season) in an attempt to get players unsuspended for a more important fixture.
When the suspension was communicated to the club, the only fixture falling in the period of suspension was a league game against Vauxhall Motors. A re-arranged fixture may not apply to the suspension period, and so Newton may have been eligible.

Droylsden have been thrown out of the FA Cup after they were found guilty of fielding an ineligible player in their second-round win over Chesterfield.
