Does anyone on here specialise in this area. Could do with some advice. Basically my girlfriend has worked for a pair of chancers for a year. They have appointed some silly woman as a manager, who called her in for a meeting tonight & advised that even though her contract states she should have a miniumum of 16 hours a week they will only now offer 8 unless she works on a Sunday, which she has already told them she can't do as she can' get any childcare. She told the new manager about her contract & she said that as she has never signed it, it doesn't count, surely this isn't correct? Also surely if she has emails from her boss saying that she doesn't have to work on Sundays, then it is a local agreement & they can't try & change this with 2 days notice? They also told her they want to move the day she is paid by 10 days, also at 2 days notice. Seems like they are trying to manage her out but surely this isn't legal. Any help or advice would be much appreciated as she is really upset as she feels like they are trying to shit on her from a great height.

Call ACAS.
 
Signed contract or not, she has a contract. To change it would need at least 28 days notice. If an agreement is in place about working hours/ days due to child care issues then that's it. Loads of rules about that these days. ACAS or CAB.

I told her to speak to CAB but it's always good to get some input from anyone who knows this area well.

The crucial thing here is that they can change her working shifts with that sort of notice unless there is an agreement in place. If they have agreed this due to her having childcare issues, and it's in writing, then she's ok.

Her contract should state any change of hours agreements signed or not.
 
Join a Trade Union. That's not being glib, that's genuine advice from someone who's worked in both private and public sector and who has always been affiliated to a union. They get decried for all sorts of shite by the right-wing loons but when workers' rights are being shafted, they are the best recourse. And retrospective joining may still be your/her best option.
