Hey Everyone,

Got a question, basically i've been getting underpaid at work for the past 3 years, i've been doing the same full time job that other people at the company are doing yet they are getting £5k a year more than me, i keep arguing this for like 2 years but all i get told is it's been reviewed etc. Im making an official grievance against the company today, i've been told that if i can prove that i have been doing exactly the same work as other people in the same role i would get back paid for the 3 years i have been underpaid?

Are you a woman ?, or disabled ? or an ethnic minority ? or a Homosexual ? ........ If you are none of these then you don't stand a chance of getting a pay rise never mind back pay.

Nope, im none of them. Suppose i could pretend to be a homosexual if it would help my chances lol.

when you took the job you knew exactly what the pay was and exactly what the job was....... if you thought the pay was too low then why take the job in the first place.

And just because someone else is doing the same job but on more money means they had better negotiating skills when they were taken on.

Aaah I see, mate. Not too sure with employment law, but I do have a mate who does that sort of thing. I'll send him an email and if nobody has replied before I get a reply I'll post here what he has to say about it.

What kind of work is it you do?

yeah lol..... but you would have to prove that you were being discriminated against because of your sexuality...... That does not seem to be the case here tho I'm afraid.
 
Got this back from my mate who works at some law firm in town:

Just spoke to a bird here who is doing her ILEX (LAW COURSE) and if he signed the contract for that annual pay, regardless if anyone else is getting paid more then that's the pay that they will receive. BUT she said one call to Citizens Advice Bureau and he can take a copy of the contract down (he should have one) and there might be something in there that he can bring up to raise an argument.


So looks like you may be stuck on the wage you are on unless a contract stipulation can help you out at CAB. Good luck pal, coz I hate shit like this.
 
Basically if you took on the job at the advertised rate and have a contract etc there isnt alot you can do.
If you know your an asset to the company, put a document together showing your worth and what you bring and ask for a meeting to discuss your salary. Do your work 1st on this and make sure you can show them your true worth. It costs employers more money to advertise and train new staff than it does to keep current ones so who knows you may get lucky. I wouldnt say in the meeting she gets this, he gets that etc as its no relevence to your request.

Also to conisider, In some companies, perhaps employees have perhaps been there decades and if that firm gives average annual pay increases across the board ie 1.5-3% then the people who have been there longer will of course have a higher salary than someone who has been there just a few years.

No this shit again. All those 'groups' that you jokingly refer to get paid less than your average white man, if they even get the opportunity to work. As you're new, I'll give you the standard question. When you find the mythical land of positive discrimination, please let me know so that I can send my children there. Until then, please stop talking bollocks.

As for the OP, you appear to have acted in accordance within express and/or implied terms of a contract of service and have thus apparently waived any right to any variation in your contract, which always requires consideration to be effective in English Law, i.e., as the employer says, what have you done out of the ordinary? You can now attempt to negotiate a new contract [but why would the employer wnat to agree to that] or rely on CAB finding a relevant term in your contract, which seems unlikely. IN my view, I'd start a fresh and say that you've been an effective and loyal employee that now deserves more. Regrettably, times are hard and the employer know that finding other work is not so easy. Sorry but there it is.

Coleridge, I never mentioned "positive discrimination" and the point I was making (if you had bothered to read my other posts as well) was that unless he could prove he had been discriminated against then he would not have a leg to stand on. Which he hasn't.

You my friend are too quick to jump on the defensive without actually reading what I posted. "Positive Discrimination" was not on the agenda and your interpretation incorrect.

Some might say you are too blinkered and maybe have a chip on your shoulder about the subject of "positive discrimination"....... calm down young man and take a deep breath before diving in feet first.

Yes you were and you won't be saved by the use of cliches ['Chip on the shoulder, et cetera']. I'm not that young and I don't need to be calm. Making unsubstantiated assertions does your intellect no favours. I respectfully suggest that you take a deep breath before regurgitating tabloid nonsense dressed up as 'fact' by without a single example to prove that particular hypothesis. There is no evidence of discrimination in the matter in question in any event and it is only you that appears to have introduced the issue for personal reasons and which do not appear to assist the OP, who was looking for advice and not a Daily Mail-esque lecture.

The reason for my initial questioning was because the OP was not very clear on the background to the current issue.

Let me put this question to you Coleridge...... If this lad rang your office and quoted what was in the OP, your first question as a "legal type" would be ... "do you think you are being discriminated against and for what particular reason ?" .... as a "legal type" you know you would as the information that was given was unclear.

All I did was to point out that these are the most common reasons for discrimination in the work place and you have chosen to knee jerk just because YOU misinterpreted the post. Its not my fault you are super sensitive on the subject. (or is that chip on your shoulder weighing you down)

If you are on an incremental salery then there is no real recourse in legal terms for you to persue a case, but if not then the age discrimination law might come into play, though I dont know enough about the terms and conditions of your employment to go further.
Coleridge, what is this "English Law" you are refering to, as to the best of my knowledge, employment law is set at Parlaiment, which covers England, Wales, Scotland and Northern Ireland, though it has to bow down to EU legislation when required.
