At what point can you take some sort of legal action against not getting a VAR decision?

There is no longer any excuse of the referee not seeing it, you have several clear replays of an elbow to the face, with all the signs referees are taught to look for, like a clenched fist.

Surely at some point, there's a point where a decision is so blatantly ignoring all FIFA refereeing guidelines that the VAR or UEFA who he's representing is liable for failure to perform their duty.
