They both have legal interests in the property so A good divorce lawyer should see her straight. However, due to the cuts in legal aid from LASPO 2013, she will not be granted legal aid to help fund her case. It all depends whether or not the mortgage is a joint mortgage which by the facts, I'd say it is and he wants away with his part of the contract. If the mortgage is not in her name, then she should have registered her interest on the Land registry

He has to transfer his legal interest to her or he shall remain liable for the mortgage as is she.

If he does transfer his interest in the property to her, she will most likely have to sell the property unless she can afford the monthly re-payments on her own. The courts may order the sale of the property and a division of the assets, they will also take into condiseration both of their contributions towards the mortgage.

Divorce and seperation is a legal minefield and It just goes to make me even more determined never to marry.
