The market value for Carlos is going to be whatever people are prepared to pay for him in January. The arbitrary figure of 50 million which we put on his head this summer based on the Torres/Carrol transfers was placed there simply because we didn't want to sell him. It was prohibitively high and City knew it.

As I said earlier - 20/25 million in January and we'll be lucky as fuck to have escaped with that and having him off the wage bill...

Time to move on from Carlos anyway... seems the only people left who care are the lawyers who will undoubtedly profit from the entire sorry episode...

Surely that is the best indicator of market value seeing as it was a done deal, on the market.
City's figure wasn't high because we didn't wanna sell him, it was a fair price based on what we paid and his added value after a very good season.

The problem is that there just isnt a sufficiently high enough volume of transfers of top football strikers that a Court, comprising of non football experts, would consider to be a reliable indicator of market value.
Its not like buying second hand cars where there are thousands of such trades.

Quoting a small number of transfers such as Torres and Carroll just wouldnt cut it for a High Court judge. Justice Old Fogey isnt going to work out that if Carroll is worth £35m, and he's a lump of wood, then Tevez must be worth £50m.

A half decent lawyer would be able to pursuade them that the market value of any player depends on a range of circumstances specific to that player and that market values of players go up and down on a daily basis (do we value him on the last day of the transfer window or the first?). In the case of Tevez they'll point out that City wanted one price for a sale to a South American club, another for a sale to a European club and yet another for a sale to a PL club.

They'll end up pursuading the judge that Tevez's market value, before Munich, could have been anywhere between £15m and £50m.

Remember the Imran Khan/Allan Lamb/Ian Botham libel case? the court had a lot of evidence about ball tampering and so on from people like Mike Atherton, Geoff Boycott, Jonathan Agnew and so on. That's what courts do - they listen to evidence about stuff they don't know much about themselves. So we end up with half a dozen experts who say Tevez was worth £50m in the summer, and they all trot out excellent reasons why, and Joorabchian's legal team (sorry, Tevez' legal team) trot out experts saying he was only worth £20m.

So when Justice Old Fogey is told that Carroll is a lump of wood that the dippers paid £35m for, he will then be told that Carroll had an inflated value to the dippers because they had just lost Torres but did have a wallet full of cash. He will be told that we have paid over the odds because of the City premium, and have accepted less than full market value to shift on some unwanted players like Bellamy. He will be told that Real paid £80m for the top goalscorer in the Wolrd's Best League when the ladyboy wanted away a couple of years ago, and be asked what the difference is.

He will listen to all of this and then decide where it takes him. Then, difficult or not, the judge decides it. That's what he's there for.

Tevez is worth what we accept, if we accept 20m then legally I can't see us being able to seek another 20m compensation from Tevez as the courts would just challenge why we accepted 20m rather than hold out for 40m.

As leading Premier League scorer, I don't see how it can be any lower than £40m

There is no way that Berbatov is worth forty million quid... so that argument doesn't hold.

Surely any old justice fogey or any member of the public who knows nowt about football will have mainly seen how outragous transfer fees are & note that Tevez, as the top scorer in the Premier League must be worth top whack ? Add to that the fact that we pay him top wages, anyone not itk would naturally assume Tevez was worth top dollar & go high rather than low when estimating his transfer value.

It's the football experts who would devalue him, not the novices surely ?

I don't think we ought to be getting steamed up about assumed value. Too many variables to construct a decent proposition.

Guilty of 5 charges relating to breach of contract and now AWOL from the club.

We can all see how it will end; my money is on Madrid ;-)
