Tevez not completed his community service!

I was out with my mate last night who works in the Courts system and a group of us City fans were all talking about it.

For a start who gives a flying F.... as he's no longer our problem, but all that will happen, is his brief will go back before the court and it will be revoked.

Apparently it happens all the time peoples circumstances change sickness, moving abroad Oil rigs etc.

If his brief says he's prepared to pay a fine then the Court may fine him £5k as a like for like sentance, but in reality the community Service Order will just be revoked and he'll walk away scot free.

Not fair but our Court system will want him off the books. The reality of him coming back to live in this Country will be zero, theres no extradition for driving whilst disqualified, the system is jammed as it is, so they will want him off their system as soon as.

Any decision has to be made by a judge on whether a donation is acceptable and if so, where the donation is to be made.

The problem is that a fine isn't a like for like sentence. He was given 250 hours unpaid work, a sentence at the top end of the range for community orders. In terms of seriousness its much closer to a custodial sentence than it is to a fine.

It might be acceptable for someone on low or average income to have say 60 hours of unpaid work outstanding to be revoked and resentenced to a large fine. But the maximum that he can be fined is £5,000 which is clearly peanuts to him. There's no way that could be described as comparable to 200-250 hours of unpaid work.

The other issue is that whatever happens to him will be very high profile. Although it might "happen all of the time" none of the powers that be will want that to be made very public as it would be in the case of Tevez.
 
I am not condoning this in any way but why did Tevez have to suffer the indignity of the type of work he was given? Other sportsmen have been given orders to coach disadvantaged kids but he was made to clean streets etc. Lets not forget the contribution he ultimately made to the best end if a season ever...
 
Court ruled out a custodial sentence when they gave him his unpaid work, if he is in breach of the order then the court could send him to custody for wilfully and persistently breaching the court order. This will not be a breach, this will be an application to revoke on the grounds that the order is unworkable because the player is leaving the jurisdiction of the court. In those circumstances the court has no option but to revoke and re sentence, but because the original court gave him a community order it cannot go up tariff, therefore it either gives a like community order, all of which would be unworkable for the same reason, therefore it will come down to a fine, the maximum being 5000K. Thats how it is IMO

5000k is enough to make a sizable dent in the Tevez coffers. Do you mean 5k / £5000?
