Had another look at the CAS 1 judgment as this Tony Evans line that the UEFA finding is not based on the leaked emails seems so unbelievable. The very strong inference from that judgment is that it is the leaked emails that are the key:

"...Between 2 and 16 November 2018, several articles were published by Der Spiegel, Reuters and Mediapart about MCFC (the so-called “Football Leaks”).
8. On 10 December 2018, the Chief Investigator of the Investigatory Chamber wrote to MCFC about these “Football Leaks”, attaching extracts of publications and inviting MCFC to comment on the accuracy thereof.
9. On 7 March 2019, following the exchange of various correspondences between the Investigatory Chamber and MCFC, the Investigatory Chamber notified MCFC that “further to our letters for your attention dated 14 and 19 February 2019, your club’s response dated 1st March 2019 and subsequent information and documents recently made public in various media outlets, an investigation is hereby formally opened in accordance with Article 12 (2) of the Procedural rules governing the UEFA Club Financial Control Body – Edition 2015 [the “CFCB Procedural Rules”]” (the “Investigation”).
10. On 28 March and 11 April 2019 respectively, hearings took place before the Investigatory Chamber.
11. On 15 May 2019, the Investigatory Chamber issued the Referral Decision."


The idea that it was something inadvertently submitted by City in response to the investigation where City are said not to have cooperated is simply implausible.

Nearly as bad as the QPR game this. Up to the day of the game I was convinced we were going to piss it. Then, on the day, I was so nervous I could barely walk from the car to the stadium and had convinced myself we were going to fuck it up.

We damn near did.
 
If we do indeed have a complete email chain that contradicts/torpedoes the content of the emails published by Der Spiegel, then I would like to think CAS would take one look and chuck the case out on the spot. Equally, if we have got such an email chain exonerating us, I’m staggered that the AC judges felt we merited a 2 year ban for serious FFP breaches.
I thought they never saw our full evidence because we submitted it at the last minute (probably deliberately) and they chose not to read it. At that point we had lost complete faith in the process which had been compromised by repeated leaks of sensitive financial information to our commercial rivals.
Because of these leaks we decided to effectively bypass the AC and that's why they say we didn't co-operate. The AC sanctioned us without seeing our defence. That may explain whey UEFA sources have claimed that "City had no evidence." We have plenty of evidence and I think CAS will give us a fair hearing.
 
I'm not talking about us blue blooded fans that have supported our club through all the ups and downs...it's about attracting new fans. Our kids will not want to support City because all their friends will be calling them "cheats".
It's already happening now....one of my City mates here in Salford was telling me how he got abuse while wearing his colours from some checkout kid at the supermarket as he was scanning is shopping! Muttering "cheat, cheat cheat" under his breath scanning each item.
That kind of thing WONT deter already established fans...but it WILL put off young kids.

I am a naive and trusting soul who always believes the best of people. But my dander gets up when I perceive unfairness. I fervently hope aspiring young blues feel that too and stick with us come what may. " Will it fuck" (put them off) says it all.

Sounds plausible. I’m getting ever more confused though - on the one hand UEFA sources are saying we presented no evidence (to prove our innocence), but on the other that scouse twat Evans is claiming that UEFA’s evidence against City is evidence we submitted which has incriminated the club. That sounds utterly ridiculous but I’ve just been thinking if it turns out to be true then “Typical City” will have returned with a vengeance and it’ll go down as a more spectacular own goal than the one Jamie Pollock scored against QPR in 1998!

Are you referring to the case itself and our expected victory or the fallout after a victory and the damage from the back draft once we open the door to the fire?

Or just the Qpr game itself?

I can picture it now. We go in on Manday quite confident but we're struggling. Pannick and the other QC, Paul Harris, aren't really firing on all cylinders and UEFA's team are defending for their lives but just before lunch on the Tuesday, they land a key blow and we're in the driving seat. Everything looks like it's falling into place for the second half of the hearing but their QC makes a great point when one of our guys gets things a bit wrong and concedes an easy point soon after lunch. Things get a bit tetchy from then and one of their lawyers gets a bit too excited and has to be sent out of the meeting.

Things look good for us but somehow Pannick nad Harris let their guard down and UEFA get their noses in front. That affects them and they can't do anything right from there on. It gets to just before 5pm on the Wednesday and UEFA look safe for the win but Harris makes a great point and it's in the balance. Pannick walks to the back of the room and gives a piece of paper to one of his support team, who digs in a file and gives him one back. Then Pannick puts the killer point to the panel as the clock ticks towrds 5. The judges look at each other and nod and case thrown out thanks to Pannicks's last minute intervention.
 
The way I see it is that both sides are confident of victory. I can't see UEFA getting this far with a case they know is bound to collapse under even the most cursory examination whilst the club can't really do anything else but proclaim confidence as we have a fucking huge sanction placed upon us and we are bound to appeal it.

In fact UEFA have two chances to win, punishment upheld or reduced to a one year ban, and we have only one.
 
I have become very wary recently of that seemingly innocuous line from uefa’s latest qualification rules, the one about ‘public perception of unfairness in qualifying’.
Why did uefa leak so much information about this case, when common sense would tell you that it could damage their own chance of winning? What punishment would we receive if they won?A 2 year ban, very damaging but not insurmountable.
Leak stuff, create smears and lies and insinuations, use a compliant and obsequious press and media, to create the image we all know we now have- and no amount of facts will change the minds of, well, pretty much every fan of every other club, here and abroad.
Then, having used the court of public opinion as judge and jury, create a new qualifying rule about ‘public perception’ and use it as executioner too.
A 2 year ban from uefa or an indefinite stream of bans voted for by hate-filled who see us as cheats, and can vote us down for years ahead.
Far-fetched? Maybe, but they are desperate to destroy us and desperate people do desperate things.
