Another problem is no one can access any of their money to help pay for their care or anything.

I have power of attorney for health for a cousin in Scotland.
Last week the guy with power of attorney for finance died of a heart attack.
This means I cannot access any of her funds to pay for her care even though she is minted.
I have taken legal advice and all I can do is apply for deptyship or guardianship as it is in Scotland. Solicitors quoted £6K and a year to set it up.
We only have access to funds for her care for 3 more months.
She has care at home at a cost of £5K a month.
I have had to tell the council unless they can help out until I get guardianship then in 3 months she will be their responsibility completely.

My sympathies fellow blue. I can add that getting Power of Attorney is a bit more straightforward since Covid started. Suggest reading this is a good starting place. It’s a Gvmt run site.

He cannot get power of attorney.
It can only be “given” by someone with full mental faculties.
Dad has dementia.
He cannot grant power of attorney.

Dennis. I can assure you and other readers from recent personal experience that it has become easier to get round the full capacity problem. Reread the link I posted.
