Correct. As far as I can see even if he was cheating on his girlfriend with the lady in the picture (and it's highly unlikely), he should sue them anyway.

Tabloid journalists (not all of them, but this kind right here) are the true scum of the earth, motivated purely by their own greed, doing anything for a payday, not caring who they hurt.
